Appeal Court Sets Legal Precedent on Women’s Matrimonial Property Rights in Sierra Leone
The Court of Appeal in Sierra Leone has made a landmark ruling that protects women’s rights to shared property after marriage. Judges ruled that a woman is entitled to a fair share of property bought during a marriage if she helped pay for it or if both partners clearly intended to share ownership, even if her name is not on the official title documents.
The ruling came in the case of Francis Tarawallie v. Satia Koroma, with the court unanimously agreeing that property disputes must be decided on evidence and fairness rather than formal ownership papers alone. The lead judge, Justice Jamestina King, emphasized that marriage does not take away a person’s rights to what they helped build or buy.
